While a producing issuer might rely on internal staff for routine mineral resource estimates, specific high-stakes events under Section 5.3 require a technical report authored by a professional who meets the reasonable person test for independence. The determination of whether to utilize an independent or an in-house Qualified Person is a strategic decision that must be made early in a project’s lifecycle because relying on in-house staff during mandatory milestones will result in a non-compliant filing (Analysis of Regulatory Mandates, 2026, Sources,. According to the Canadian National Instrument 43-101 framework, an independent technical report is triggered when an issuer becomes a reporting issuer in a Canadian jurisdiction for the first time, files a long-form prospectus, or discloses a maiden resource, reserve, or preliminary economic assessment (Analysis of Regulatory Mandates, 2026, Source).
